Terms of Use

By using the website (publictender.mt) and the “Procurement Monitor” service provided by Közbeszerzés Figyelő Ltd. (hereinafter referred to as the Provider), you as the User accept the following Terms of Use.


1. The Service Provided

The Procurement Monitor service allows Users to monitor public procurement notices published on the Tender Electronic Daily (TED) and other relevant Maltese and EU tender sources. Based on the User’s defined search settings, the service continuously scans new announcements and notifies Users by email with direct links to relevant public tenders. Past notices can also be searched via the online platform.

3. General Terms of Use

3.1 Upon subscription, Users can define the topics and countries of interest via the administration interface.

3.2 Email notifications contain links to public procurement notices matching the search criteria. Full notices are not provided—only links to the original sources.

3.3 Reports are sent automatically only when matching tenders are found.

3.4 Content is identified by automated algorithms. The Provider assumes no responsibility for accuracy, completeness or relevance.

3.5 Invoices issued to EU-based companies (excluding Malta) that provide a valid VAT number are exempt from VAT under Directive 2002/38/EC. VAT is also not charged to non-EU residents and companies.

3.6 The Provider may use anonymized data for analytical and statistical purposes.

3.7 The Provider reserves the right to suspend or deny service to any User in case of suspected misuse or legal violation.

3.8 The Provider disclaims any liability for damage resulting from use of the service or interruptions thereof.

3.9 Service availability is not guaranteed. Interruptions or maintenance-related downtimes may occur.

3.10 The service is intended exclusively for the registered User. Organizational accounts may register up to three additional users (email addresses), who must be employees or internal members. Individual Users may only register their own email(s). Redistribution, resale, or forwarding of the service to third parties is prohibited.

3.11 Violation of section 3.10 may result in immediate termination of access, and the User may be held liable for damages.


4. Registration

4.1 To use the service, registration is required. Users must provide accurate and truthful information.

4.2 Required data for legal entities:

  • User’s email address

  • Company name and billing address

  • Contact person’s name, email and phone number

  • Business activity area

4.3 During registration, the User must select at least one “business profile” from the list provided by the Provider.

4.4 By registering, the User consents to the storage and processing of all submitted data, as well as the IP address of the device used.

4.5 The agreement is concluded in the language of the registration interface and does not constitute a written contract. It is not filed by the Provider.


5. Pricing and Subscription Plans

5.1 Users are required to pay the following subscription fees based on their selected plan:

  • Malta Plan: €99/year
    Access to public procurement notices from Malta only. Includes 1 business profile.

  • Malta + EU Plan: €199/year
    Access to public procurement notices from Malta and all EU member states. Includes unlimited business profiles and full access to historical data.

5.2 Payment can be made via bank transfer, PayPal, or credit card.

5.3 The service is activated upon confirmation of payment. The Provider issues an electronic invoice to the User via email.

5.4 By subscribing, the User expressly agrees:

  • to the immediate activation of the service upon payment,

  • that this constitutes the start of a digital service delivery,

  • and therefore the User waives their right of withdrawal in accordance with EU Directive 2011/83/EU Article 16(m).

5.5 We use your personal data to process your order, maintain your experience on the website, and for other purposes described in our Privacy Policy.


6. Contract Term and Termination

6.1 The subscription is valid for 12 months from the date of activation.

6.2 Either party may terminate the contract at any time in writing. No refunds will be issued for ongoing periods after activation.

6.3 The Provider may terminate access immediately in case of:

  • material breach of these Terms,

  • non-payment of fees after a written reminder,

  • or misuse of the service.


7. Responsibility for Content

7.1 The Provider does not generate, edit, or control the tender content linked through the service. It only provides access.

7.2 The Provider acts solely as a search and filtering tool and assumes no responsibility for the accuracy, timeliness, or completeness of third-party content.


8. International Use

8.1 Due to the cross-border nature of the service, Users must comply with all applicable laws in their country of residence. Use of the service in violation of local law is entirely at the User’s risk.


9. User Data and Deletion

9.1 Users must update their data if changes occur.

9.2 Passwords must be kept secure. Any suspected breach must be reported and the password changed immediately.

9.3 Users may delete their account at any time. Personal data will be deleted unless retention is required for legal or billing purposes.

9.4 Billing and transaction data are stored only as long as necessary by law.

9.5 The Provider may delete an account at its sole discretion.


10. Data Protection

10.1 This section applies to personal data of natural persons only.

10.2 Personal data is processed voluntarily and in compliance with EU and Maltese data protection laws.

10.3 Data is used to identify the User, for service delivery, and to generate usage statistics. No data is shared with third parties.

10.4 The Provider may display personalized content or ads related to the User’s preferences. Users may opt out.

10.5 All data processing is automated. The Provider takes appropriate technical and organizational security measures.

10.6 Users may access, correct, or delete their data via the dashboard or by email: hello@publictender.cz.

10.7 Users may seek legal remedy if the Provider fails to comply with their obligations. Before pursuing legal action, the User must first contact the Provider with a written complaint.


11. Amendments to the Terms

11.1 The Provider reserves the right to modify these Terms unilaterally. Users will be informed in advance.

11.2 The modified Terms shall take effect upon publication on the website.
